Who You Are Contracting With

Beach Better is a trade name of Destin Sunshine LLC, a Florida limited liability company, doing business as Beach Better. Destin Sunshine LLC d/b/a Beach Better is the party to every rental agreement, service order, parts sale, and vehicle sale described on this page.

Rental Policies And Florida LSV Laws

Street-legal Low Speed Vehicle rentals in Miramar Beach, Destin, Santa Rosa Beach, and 30A.

Who May Drive

Every driver must be 22 years of age or older for the entire rental period, hold a valid state-issued driver's license, carry active auto insurance naming that driver, and be listed and approved on the executed rental agreement before driving. Two drivers are included with every rental. Each additional driver is $15 and must be added and approved online before taking the wheel. Only approved, listed drivers receive lockbox codes. Allowing any other person to operate the LSV is a prohibited use that voids coverage and shifts responsibility to the renter.

What You Are Renting

Every Beach Better rental is a street-legal Low Speed Vehicle as defined by Fla. Stat. 320.01 and 49 C.F.R. 571.500: a titled, plated, registered and insured motor vehicle. Under Fla. Stat. 316.2122 an LSV may be operated only on public roads posted 35 mph or less, the operator must hold and carry a valid driver's license, and the vehicle must be registered and insured as a motor vehicle. The same traffic laws that govern a car govern an LSV.

Handling, Rollover Risk And Assumption Of Risk

An LSV is a real motor vehicle and it carries real risk. It sits higher and weighs less than a car, it is open to the air, and it can tip or roll over, particularly during a sharp, sudden or fast turn, on a slope or uneven surface, or when overloaded. Slow well before you turn, take corners gently, keep every rider seated and belted, and never overload the vehicle or let anyone ride on a lap. Most incidents on a low speed vehicle come from turning too fast rather than from straight-line speed.

The rental agreement asks you to acknowledge and expressly assume these inherent risks for yourself, your passengers, your guests, and any minor for whom you sign. Read the assumption of risk and release sections of the agreement in full before you sign.

Insurance, And What Your Policy May Not Cover

Under Fla. Stat. 627.7263 your own valid and collectible liability and personal injury protection coverage is primary: "The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021(7) and 627.736, Florida Statutes."

Many personal auto policies and credit card benefits exclude Low Speed Vehicles. Confirm with your own insurer, in advance, that your policy covers your operation of a rented Low Speed Vehicle. Renter's Collision Protection is optional secondary coverage and does not replace your primary policy. Keep proof of insurance with you whenever you drive.

Renter's Collision Protection (RCP) And Damage Forgiveness (DF)

  • Renter's Collision Protection (RCP): optional, $39.50 per approved driver, per day, billed in 24-hour periods from purchase, with a $500 deductible per incident.
  • Damage Forgiveness (DF): optional, $8.00 per day.
  • Secondary, never primary: neither product alters the primacy of the renter's own coverage under Fla. Stat. 627.7263.
  • Non-transferable: each driver who wants RCP purchases their own, and it is non-refundable once added to a reservation.
  • Purchase timing: RCP must be purchased before the rental agreement is signed and cannot be added afterwards.
  • Collision only: RCP does not cover theft of the rental LSV.
  • Voided by prohibited use: any prohibited use of the LSV, including operation by anyone who is not an approved, listed driver, invalidates both RCP and DF.
  • Governing terms: the operative terms of RCP and DF are those set out in the rental agreement you sign. This page is a summary and not a substitute.

Florida LSV Operating Rules: Strictly Prohibited

The following are prohibited under both Florida law and the Beach Better rental agreement. Each one ends the rental on the spot: the LSV is recovered and no refund is issued for unused time.

Zero Tolerance: Rental Ends, Vehicle Recovered, No Refund

Prohibited Uses

  • No unapproved drivers. Only drivers listed and approved on the executed agreement may operate the LSV.
  • No alcohol or drugs while operating the LSV. Florida DUI laws apply.
  • No phone or device use of any kind while operating the LSV, including hands-free. No headphones or earbuds. Bring the vehicle to a complete stop in a safe, lawful location before using a phone or device.
  • No travel along US Highway 98 (Emerald Coast Parkway) or Business 98, or on their shoulders or pedestrian paths. Crossing at a signalized intersection is the only permitted interaction.
  • No standing passengers. Every rider must be seated with the belt fastened.
  • No lap riding and no sharing a belt, for riders of any age.
  • No pets in or on the LSV, other than a service animal.
  • No items on the roof: no cargo, chairs, coolers, or any objects.
  • No use on sidewalks, beach sand, dunes, or trails. Public roads posted 35 mph or less, only.
  • No overloading: never carry more people than the LSV has seat belts.

Highway 98

You may cross Highway 98 (Emerald Coast Parkway) only at a signalized intersection, in the marked travel lane, and only where the crossing road is posted 35 mph or less. You may never travel along Highway 98, Business 98, or their shoulders or pedestrian paths, in either direction. Driving along Highway 98 ends the rental immediately, the LSV is recovered, and no refund is issued for unused time.

Required Safety Practices

  • Seat belts: every rider must be in a seat with the belt fastened at all times while the LSV is in motion. Fla. Stat. 316.614 requires seat belt use in a motor vehicle, and an LSV is a motor vehicle.
  • Children: fla. Stat. 316.613 sets the child restraint rule: a child aged 3 or younger must ride in a crash-tested, federally approved separate child carrier or the vehicle manufacturer's integrated child seat, and a booster seat is not sufficient at that age. A child aged 4 or 5 must ride in a separate carrier, an integrated child seat, or a child booster seat. Beach Better does not supply or install child restraints.
  • Phones: Florida law prohibits operating a motor vehicle while holding a wireless communication device. Beach Better's policy goes further: no phone or other electronic device may be used in any form, including hands-free, while the vehicle is in motion. Headphones, earbuds, and texting while driving are prohibited. Bring the vehicle to a complete stop in a safe, lawful location before using a phone or device.
  • Headlights: headlights on Beach Better LSVs are manual and do not switch on automatically. Turn them on by hand from sunset to sunrise and any time visibility is reduced by rain, fog or spray. Florida law requires lighted headlamps on a motor vehicle in those conditions. Position 1 is low beam. Position 2 is high beam.
  • Pre-trip walkaround: before your first drive, walk around the LSV, check the tires and lights, and confirm every seat belt latches. Do not operate a vehicle you believe is unsafe.
  • Damage and accident reporting: report all damage, accidents, or mechanical issues immediately by texting (850) 830-4699. After any accident, call 911, remain at the scene until released by law enforcement, obtain a police report and report number, and then contact Beach Better.

Cancellations And Refunds

Within 10 Days Of Your Start Date

No refund for cancellations made within 10 days of your scheduled rental start date.

10 Or More Days In Advance

A $50 cancellation fee applies to all cancellations made 10 or more days before your rental start date.

Early Returns

Early returns are not refunded, for any reason.

Hurricane Or Unforeseen Safety Events

Unused days are refunded on a prorated basis only when Beach Better requires the LSV to be returned because of a hurricane, tropical storm, or other unforeseen safety issue.

Policy Violations

No refund is issued if your rental is terminated for a prohibited use, including travel along US Highway 98, riding without seat belts fastened, carrying a child without the child restraint Fla. Stat. 316.613 requires, or operation by an unapproved driver.

Weather Retrieval

Beach Better may retrieve rental vehicles during severe weather, tropical storms, or hurricanes for safety purposes.

Additional Fees, Billed To The Card On File

The following fees are automatically charged to the credit card on file when the listed condition occurs. Damage to the LSV is charged at actual repair cost.

Your rental agreement carries this statutory statement, which you initial when you sign: "Failure to return rental property or equipment upon expiration of the rental period and failure to pay all amounts due (including costs for damage to the property or equipment) are evidence of abandonment or refusal to redeliver the property, punishable in accordance with section 812.155, Florida Statutes."

Important Rental Requirements And Reminders

  • Neighborhood verification: you are responsible for confirming that your rental location, whether a neighborhood, an HOA, or a vacation rental property, allows Low Speed Vehicles before booking. See the Neighborhood Rules page.
  • Authorized drivers only: only drivers listed and approved on the executed rental agreement may operate the LSV. Lockbox codes are released only to those drivers, and only after every driver on the reservation is approved and the agreement is executed.
  • Return condition: an electric LSV must be returned charged to full and left plugged in, and returning it under 90% charge triggers the $100 recharge fee. A gas LSV must be returned with a full tank unless prepaid fuel was purchased.
  • Read before you drive: your unit's operating guide and the Florida LSV law summary are sent to you in writing at booking and again on the first day of your rental. Read both before you drive.
  • Service area: rentals are available in Destin, Miramar Beach, Santa Rosa Beach, and along Scenic Highway 30A.

Electronic Signature, Arbitration And Venue

Your rental agreement is executed electronically. Electronic signatures and initials are valid, binding and enforceable under Fla. Stat. 668.004, the Florida Uniform Electronic Transaction Act at Fla. Stat. 668.50, and the federal Electronic Signatures in Global and National Commerce Act at 15 U.S.C. 7001.

Please read this before you book. The rental agreement requires disputes to be resolved by final and binding individual arbitration seated in Walton County, Florida, under the Federal Arbitration Act, and it contains a class action waiver and a jury trial waiver. For any dispute not subject to arbitration, exclusive venue lies in the state or federal courts in and for Walton County, Florida, and Florida law governs. The agreement also contains an express assumption of risk, a release of liability, and an indemnification provision.

Repair, tune-up, tire service, and mobile mechanic appointments in Miramar Beach and across the Emerald Coast.

Appointment Timing

Your scheduled start time is our target, not a guarantee. Our technicians may arrive up to one hour before or after your appointment window, because traffic and weather on the Emerald Coast are real factors. We appreciate your patience and always aim to minimize wait times.

Access Requirements

You are responsible for ensuring your vehicle and key are accessible at the scheduled time and location. If our technician arrives and cannot access the vehicle or key, the appointment is considered a missed service:

  • No refund is issued.
  • The appointment is not rescheduled without payment of a new service fee.

Payment And Disputes

Payment is due in full at the time of service unless otherwise agreed in writing. By booking a service appointment with Beach Better, you agree not to initiate a credit card chargeback without first contacting us to resolve the issue. These terms are governed by the laws of the State of Florida.

Golf Cart Inspection Disclosures

Scope And Limitations

All inspections are visual and operational assessments based on accessible components at the time of evaluation. Recommendations are preliminary estimates that may change upon further disassembly, testing, or discovery of additional issues. Beach Better reserves the right to revise diagnoses and cost estimates as work progresses.

What We Are Not Responsible For

  • Pre-existing conditions, wear items, or hidden defects not reasonably discoverable during inspection.
  • Issues that develop after the inspection date.
  • Problems caused by normal wear and tear, misuse, or lack of maintenance.
  • Consequential damages resulting from vehicle downtime or repair delays.

Documentation And Record Keeping

By authorizing an inspection, you consent to Beach Better documenting your vehicle's condition through photographs, notes, and diagnostic data. These records are stored in your customer profile and may be shared with manufacturers, insurance companies, or legal representatives when necessary for warranty, liability, or safety purposes.

Estimates And Authorization

  • All cost estimates are valid for 30 days and subject to parts availability and market pricing.
  • No work is performed without your written authorization.
  • Estimates do not constitute a guarantee of final repair costs, which may increase due to unforeseen complications.

Safety Disclaimer

An inspection does not certify the vehicle as safe for operation. Continued use of a vehicle with identified defects is at the owner's risk. Beach Better recommends immediate attention to all safety-related issues identified in an inspection report.

Parts And Accessories Return Policy

Parts, accessories, and components purchased at Beach Better in Miramar Beach, Florida.

Return Window

Accessories may be returned within 7 days of the purchase date.

Condition Required

Items must be returned in the same condition as when sold, unused and in original packaging.

Restocking Fee

A 15% restocking fee is deducted from all refunds.

Refund Timeline

Refunds are issued to the original payment method within 14 business days.

Non-Returnable Items

Golf carts, Low Speed Vehicles, installed parts, special orders, and clearance items are sold as-is and cannot be returned or exchanged. The customer is responsible for arranging and paying for return shipping where applicable.

Assembled From Parts (ASPT): What Buyers Must Know

Critical Buyer Disclosure

What is an ASPT vehicle? ASPT stands for "Assembled from Parts." This designation applies to vehicles that have been constructed or reconstructed using components from various sources, including different manufacturers or salvaged parts. The year listed on the title may not reflect the original manufacturing year of the vehicle.

Buyer Acknowledgment And Disclosures

By purchasing an ASPT-designated vehicle from Beach Better, you acknowledge and agree to the following.

Vehicle History

The vehicle has been assembled from parts of various origins. The year listed on the title may not match the original manufacturing year of the vehicle.

Warranty And Liability

Beach Better provides no warranty, express or implied, on the performance, safety, or reliability of ASPT vehicles. The buyer assumes all risks associated with ownership and use.

Inspection And Certification

The vehicle has passed all required inspections and meets legal standards for road-worthiness. Due to its assembled nature, performance and longevity may vary.

Resale Value

The ASPT designation may affect the vehicle's resale value. Buyers should consider this before completing their purchase.

Insurance Considerations

Insurance coverage and premiums for ASPT vehicles may differ from standard vehicles. Consult with your insurance provider before purchasing an ASPT vehicle.

Buyer Confirmation

Warranty Terms And Conditions

Eligibility and defect determination are at the sole discretion of VCarts. VCarts may require parts to be returned to the Houston-area warehouse or destroyed. The warranty is non-transferable and covers the original purchaser only.

Transportation And Pickup Fees

Customers are responsible for all roundtrip transportation and pickup fees for warranty service. VCarts does not reimburse these costs.

What Is Not Covered

  • Tires, valve stems, wiper blades, and consumable components.
  • Abuse, misuse, or neglect.
  • Unauthorized modifications.
  • Use of non-OEM parts.
  • Improper maintenance or charging.
  • Commercial or rental use.

VCarts V3-Power Battery Warranty

4 Years

Full replacement of a V3-Power branded battery.

Plus 2 Years Prorated

Prorated replacement for manufacturer defects.

Labor Warranty

If a battery fails from a manufacturer defect within 4 years, VCarts provides replacement service and labor at no charge at their Katy, Texas facility. First-year labor may also be covered by authorized dealers such as Beach Better.

Warranty Start Date

Coverage begins on the date of purchase per the bill of sale from an authorized VCarts dealer. If that is unavailable, VCarts uses the dealer sale date.

Replacement And Shipping

All replacements are brand new and never refurbished. Free shipping to any business address in the lower 48 states. The customer is responsible for local battery recycling.

What Is Not Covered

  • Improper installation or maintenance.
  • Water exposure, freezing, fire, or accidents.
  • Overcharging, undercharging, or running the battery dead.
  • Unintended applications or extreme temperatures.
  • Tampering, reverse polarity, or environmental damage.
  • Normal wear and tear from high usage.

VCarts and Beach Better reserve the right to determine if a battery has reached its natural end of life, even within the warranty period.

Legal Notes

This warranty replaces all other warranties, express or implied. VCarts and Beach Better are not liable for incidental or consequential damages.

Warranty Processing Guidelines

Getting Started

To be eligible for warranty coverage:

  • Register the warranty within 30 days of the invoice date.
  • Open a warranty ticket with VCarts Tech Support.
  • Respond to troubleshooting questions.
  • Complete any requested tasks.
  • Send photos of affected parts by email or text.

Important Reminders

Failure to follow the VCarts setup, operation, and maintenance instructions voids the warranty.

Shipping And Replacement

Approved claims ship via standard ground. Expedited shipping is available at additional cost.

Respectful Communication Required

Abusive language or profanity in any communication may result in a voided warranty.
